Privacy policy

This website is run by James Marshall, trading as James Marshall Garden Design, based in Guernsey. I am the “controller” of your personal information under the Data Protection (Bailiwick of Guernsey) Law, 2017. You can contact me about anything in this policy at Email address loading….

When you send an enquiry through the form, I receive your name, email address, phone number (if you give it), the services you’re interested in and anything you tell me about your garden.

When you email, call or message me, I receive the details you choose to share, such as your contact details and information about your garden and project.

If we work together, I also hold what’s needed to deliver your project: your address, photographs and measurements of your garden, designs, correspondence, quotes and invoices.

When you visit the website, the hosting provider automatically records standard technical information, such as your IP address, browser type and the pages requested, to keep the site running securely. I don’t use this to identify you.

• To reply to your enquiry and discuss your garden. This is in both our interests and, where you ask me for a quote, a step towards entering a contract with you.
• To design, plan, carry out and look after your project, as part of our agreement.
• To keep financial and business records, as the law requires.
• To keep the website secure and protect the enquiry form from spam and misuse.

I don’t send marketing emails, and I won’t add you to any mailing list. I don’t make automated decisions about you.

This website doesn’t use cookies, analytics or advertising trackers, and it doesn’t load content from social networks. The link to Instagram only takes you to Instagram if you click it; from then on, Instagram’s own privacy policy applies.

I never sell your information. I only share it with trusted services that help me run my business, and only as much as they need:

• Vercel, which hosts this website.
• Resend, which delivers enquiry-form messages to my inbox. Enquiries are processed in its European (Ireland) region.
• IONOS, which provides my email.
• People I work with on your project, such as landscapers or plant suppliers, but only with your knowledge and only what they need to do the work.

Some of these providers are based in, or use services in, the UK, the European Union or the United States. Where your information is handled outside Guernsey, they protect it with recognised safeguards, such as contractual protections approved for international data transfers.

• Enquiries that don’t lead to a project are deleted within 12 months of our last contact.
• If we work together, I keep project records for as long as needed to deliver and look after your garden, and financial records for six years afterwards, as the law requires.

You have the right to:

• ask for a copy of the personal information I hold about you;
• ask me to correct anything that’s wrong or incomplete;
• ask me to delete your information, where I don’t need to keep it;
• object to, or ask me to limit, how I use it.

If you’re unhappy with how I’ve handled your information, please tell me first so I can put it right. You also have the right to complain to the Office of the Data Protection Authority, Guernsey’s data protection regulator.

Your information is stored with reputable providers that use encryption and strong security. This website is served securely over HTTPS, and my accounts are protected with strong passwords.

If I change how I handle personal information, I’ll update this page and the date at the top.
